The valuation of trade secrets (confidential information) under Articles 98 and 99 of the Italian Industrial Property Code requires the application of economic, financial, and market-based criteria while also considering the relevant legal framework. This study provides an overview of the main valuation approaches, accompanied by a legal introduction to the protection and use of confidential information in connection with other intangibles such as know-how.
La valutazione dei segreti industriali (informazioni segrete) ai sensi degli artt. 98 e 99 cod. prop. ind. richiede l’applicazione di criteri economici, finanziari e di mercato, considerando il quadro giuridico di riferimento. Questo studio fornisce una panoramica dei principali approcci valutativi, accompagnata da un’introduzione giuridica sulla protezione e l’utilizzo delle informazioni segrete, associata ad altri intangibili come il know-how.
