LIFE AND DEATH OF THE LEX ABSTRACT: The idea of the tendential 'perpetuity' of the lex, despite a plurality of sources attesting many cases of abrogatio legis, has been long supported by the most authoritative scholars among Roman law studies and it is still a strong traditional concept widely implemented in manuals. The aim of this essay is not only to claim that there were no unrepealable laws in Rome, but also to show the reasons of this academic opinion.
L’idea della tendenziale ‘perpetuità’ della lex, nonostante una pluralità di fonti attestanti altrettanti casi di abrogatio legis, è stata a lungo sostenuta dai più autorevoli esponenti della disciplina romanistica ed è tuttora un’idea forte, tralatizia, ampiamente recepita anche in sede manualistica. Nel saggio, oltre a sostenere che non esistevano a Roma leggi considerate inabrogabili, si mostrano le ragioni di tale opinione dottrinale.
