Sindacato sul decreto di sequestro e rito camerale non partecipato: le Sezioni Unite mutano indirizzo

The Joint Divisions of the Italian Supreme Court of Cassation – overturning a long-standing case-law – ruled that after an appeal concerning the legitimacy of a search and seizure order, pursuant to Section 325 ICPC the procedure to be followed before the Court of Cassation is the one provided for by Section 611 ICPC, without the attendance of the parties or the possible release of closing arguments.

Le Sezioni Unite, mutando un indirizzo dalle stesse espresso nei primi anni ‘90 del secolo scorso, hanno affermato il principio di diritto secondo cui in caso di ricorso per cassazione proposto a norma dell’art. 325 c.p.p., avverso il sequestro probatorio o in materia di cautele reali, il rito camerale deve seguire le forme non partecipate di cui all’art. 611 c.p.p., e non quelle tipiche previste dall’art. 127 c.p.p. che prevedono la partecipazione e l’intervento delle parti.
