The essay, the first part of which was published in the n. 3/2014 of the review, deals with the impact of law n. 92/2012 (so called Fornero law) on the regulation of collective dismissals. The author examines in the first place the historical evolution of the regulation, outlining amongst the most critical points the long lasting dualism with the individual dismissal on objective ground, which was originated by the obscure formulation of sect. 11 of law n. 604/1966. The legislative regulation of collective dismissals, eventually realised by law n. 223/1991, did not solve the problem: on the contrary, the separation has been consolidated, though along other lines, mainly because the prevailing jurisprudence denies the judges the power to control the economic rationale of collective dismissals. In author’s opinion, the Fornero law, though intervening in an quite awkward way, ended up involuntarily strengthening the prevailing position of scholars, who assimilate the “objective ground” of individual dismissals and “the reduction or transformation of activity or work” of collective dismissals: the thesis that upholds a unitary reconstruction of small and big dismissals for economic reasons appears to be particularly opportune also from the policy point of view, thanks to the fruitful exegetic synergies which it is able to bring about.
Il saggio, la cui prima parte è stata pubblicata sul n. 3/2014 della Rivista, si occupa dell’impatto della legge. n. 92/2012 (cd. legge Fornero) sulla disciplina dei licenziamenti collettivi. L’autrice esamina anzitutto l’evoluzione storica dell’istituto, rilevando tra i punti di maggiore criticità il lungo dualismo con il licenziamento individuale per g.m.o., inaugurato a seguito dell’art. 11, l. n. 604/1966. La regolazione legislativa della materia ad opera della legge n. 223/1991, lungi dal ricomporre l’artificiosa frattura, l’ha consolidata su altre linee, soprattutto in ragione dell’orientamento giurisprudenziale prevalente che propende per l’a-causalità del licenziamento collettivo ed esalta il controllo sociale operato dai sindacati, in contrapposizione a quello giudiziale sul g.m.o. che connota il licenziamento individuale per motivi economici. Secondo l’autrice la legge Fornero, pur intervenendo nella materia in modo piuttosto maldestro, finisce involontariamente per rafforzare l’esegesi dottrinale maggioritaria che sostiene l’assimilazione tra il g.m.o. e la “riduzione o trasformazione di attività o di lavoro”: la ricostruzione unitaria dei licenziamenti economici piccoli e grandi risulta opportuna anche su un piano di policy, per le proficue sinergie interpretative che può dischiudere.
