A full discussion of the implementing provisions of article 13 of the EU directive, regulating damage compensation and profit disgorgement. It shows that the latter remedy cannot be explained in the terms of the traditional damage doctrine or of unjustified enrichment. It is rather a remedy typical of the violation of market rules.
