This paper offers an exegesis, paying the best attention to the context of agriculture during the Roman period.

I §§ 4,5,9 Dig. 39.3.1 rendono conto del tentativo della giurisprudenza di individuare la soluzione migliore in tema di esperibilità dell’actio aquae pluviae arcendae nel caso di scavo di fossae o sulci aquarii a seconda che questi manufatti di piccola bonifica agraria siano o non siano funzionali alle tecniche di coltivazione della terra. Il presente contributo propone un’esegesi il più possibile attenta anche al contesto dell’agricoltura di età romana.
