Recensione a Eusebi L. (a cura di), Biobanche. Aspetti scientifici ed etico-giuridici, Vita & Pensiero, Milano, 2014

The essay reviews the book “Biobank. Scientific, ethical and legal aspects”, which examines with a multidisciplinary approach the organization and the regulation of the repository of biological samples. Given the various topics treated by the Authors, the book review highlights the following ones: the definition of biobank; the analysis of the several activities carried out by biobanks; the distinction among biobanks, collections of biological samples and historical collections; the legal framework related to the ownership of the biological materials and the implications of the concepts of 'consent' and 'privacy'; the examination of the normative regulation (generally, soft law); the difficulties in the coordination among biobanks and the transfer of biological samples; finally, the role of Ethics Committees.

La recensione si occupa del libro “Biobanche. Aspetti scientifici ed etico-giuridici”, in tema di organizzazione e regolamentazione delle raccolte di materiali biologici umani, secondo un approccio multidisciplinare. La lettura critica del volume si sofferma in particolare su alcuni dei contenuti di maggiore rilievo: la definizione di biobanche o banche biologiche/genetiche; l'analisi delle varie attività svolte da tali enti; la distinzione tra biobanche, collezioni di materiali biologici e collezioni storiche; la disciplina giuridica relativa alla titolarità dei materiali biologici e le implicazioni sui temi del consenso e della tutela della privacy; l'esame delle fonti normative, generalmente regole di “soft law”; le difficoltà di coordinamento tra le biobanche e di trasferimento dei campioni biologici; il ruolo dei Comitati etici.
