The paper analyses the actual position of farmers (imprenditori agricoli) in case of insolvency in Italy. Moving from the 2012 Corte Costituzionale’s ruling the paper go through the exam of different positions in literature on farmers and bankruptcy, concluding for the opportunity of a legislative action aiming to remove the difference of regulation between farmers and other entrepreneurs on this matter.
