LIVEAS o non LIVEAS. Il diritto all’assistenza e la riforma dell’ISEE in due pronunce discordanti

Taking as its starting points two questionable judgments of the Constitutional Court (nn. 296-297/2012), the essay investigates the provision of some social and health services to the disabled and the elderly. These services are not charge-free; therefore inequalities may arise with regard to access and enjoy-ment of them. Due to inconsistencies in statute and case-law, a new regulation is required to ensure that the burden of non-self-sufficiency is not left on the shoulders of disadvantaged families, but is shared among all the citizens, through general taxation.

Muovendo da due discutibili pronunce della Corte costituzionale (nn. 296-297 del 2012), il contributo affronta il problema dell’erogazione, verso i soggetti di-sabili e gli anziani non autosufficienti, di alcune prestazioni socio-sanitarie che, in quanto onerose, rappresentano fonti di diseguaglianze nell’accesso e nel loro godimento. Mancando omogeneità sul piano normativo e giurisprudenziale, si auspica un intervento del legislatore che addossi non sulle famiglie più sfortunate, ma – ad esempio – sulla fiscalità generale il peso della non autosufficienza.
