The article deals with harassment, sexual harassment and mobbing at the workplace in the Italian employment law. As to harassment and sexual harassment, the Italian legal order has transposed quite accurately the directive of the European Union, but the practical application (judicial decisions) remains quite scarce. The decisions on the “mobbing” are, by contrast, very numerous by now: actually, “mobbing” is a jurisprudential invention. However, the conditions by which judges admit “mobbing” are rather strict.

Abstract: | L’article est dédié à l’exposition du droit italien en matière de harcèlement, harcèlement sexuel et harcèlement moral. Quant à le harcèlement et à le harcèlement sexuel, le système italien a transposé les directives de l’Union européenne sans trop de fantaisie, et l’application pratique (décisions jurisprudentielles) demeure assez limitée. Les arrêts sur le harcèlement moral, au contraire, sont désormais très nombreux : la figure du « mobbing » est une invention jurisprudentielle qui, pourtant, présente des conditions assez difficiles à remplir. |
