The paper begins with an analysis of the role of the “vulnerable victim” category in the criminal justice system. The aim is to assess its scope, implications and impact on safeguards for offenders, suspects and defendants. Through an examination of both substantive and procedural law, the work seeks to demonstrate how the adoption of this category has frequently been used to justify the progressive intensification of sanctions and the implementation of differentiated procedural protections, without resulting in a more comprehensive and effective recognition of the needs of victims. From this perspective, the study proposes promoting an inclusive model of justice based on holding those involved in handling the crime accountable, with the aim of healing the rift caused by the offence where possible, including through restorative justice processes.

Abstract
The paper begins with an analysis of the role of the “vulnerable victim” category in the criminal justice system. The aim is to assess its scope, implications and impact on safeguards for offenders, suspects and defendants. Through an examination of both substantive and procedural law, the work seeks to demonstrate how the adoption of this category has frequently been used to justify the progressive intensification of sanctions and the implementation of differentiated procedural protections, without resulting in a more comprehensive and effective recognition of the needs of victims. From this perspective, the study proposes promoting an inclusive model of justice based on holding those involved in handling the crime accountable, with the aim of healing the rift caused by the offence where possible, including through restorative justice processes.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
