Planetary Boundaries and Administrative Discretion The article analyses the impact of the so-called “planetary boundaries” theory on environmental policies and on the exercise of discretionary power by public administrations. Starting from the European reception of this scientific paradigm, the author highlights how ecological thresholds have become actual binding legal limits, capable of reshaping the internal geography of administrative discretion, both quantitatively and qualitatively. The article proposes interpreting the concept of “ecological balance” as a new structural constraint, comparable to budgetary balance, from which derives a reconfiguration of administrative discretion – both through the parameterization of decision-making and the return to a normative hierarchy of interests. The administrative power, thus redefined, is based on an ecological conception of the legal order, in which the protection of the ecosystem constitutes the logical and legal prerequisite of any legitimate activity.
L’articolo analizza l’impatto della teoria dei cosiddetti “limiti planetari” sulle politiche ambientali e sull’esercizio del potere discrezionale da parte delle pubbliche amministrazioni. A partire dal recepimento europeo di tale paradigma scientifico, l’autore evidenzia come le soglie ecologiche diventino veri e propri limiti normativi inderogabili, in grado di ridisegnare la geografia interna della discrezionalità amministrativa, sia dal punto di vista quantitativo che qualitativo. Si propone una lettura del “pareggio ecologico” come nuovo vincolo strutturale, simile al pareggio di bilancio, da cui discende una riconfigurazione della discrezionalità amministrativa, sia per effetto della parametrizzazione decisionale sia per il ritorno a una gerarchizzazione normativa degli interessi. Il potere amministrativo, così ridefinito, si fonda su una concezione ecologica dell’ordinamento, in cui la tutela dell’ecosistema costituisce presupposto logico e giuridico di ogni attività legittima.
