Figure dell'origine. Fonti e saperi storico-giuridici

Our research starts from the crisis of legal sources, philosophically understood as a crisis of a particular order of discourse: the formalistic one. We investigate the historical origins of the metaphor of the source, searching for a discourse that could be meaningful for the present. However, the question of origin reveals a recursive process; historical and legal sources and methods intertwine, questioning knowledge itself. Alongside the technical-definitional use of the figure of the source, inseparable from textual form of law, tradition also preserves mythical and artistic uses. Cultural formation emerges as the primary source of law.
