This study revisits the theoretical debate on obligations, which has recently been reignited by new regulations on corporate crisis management and over-indebtedness, as well as by the spread of models of self-enforcement in favour of creditors. While the (including regulatory) aspects evoked certainly show that the path of contract law in our times must be directed towards the legitimisation of instruments that accommodate increasingly complex dynamics, in the name of effective protection of creditors' interests, these instruments do not seem to lead us to discard as outdated the model of cooperative obligation that seemed to have become established in our conceptual reflection.
Questo studio torna sul dibattito teorico sull’obbligazione, in tempi recenti ravvivato dalle novità normative in punto di gestione della crisi d’impresa e del sovraindebitamento, nonché dal diffondersi di modelli di autotutela esecutiva in favore del creditore. Se i profili (anche normativi) evocati certamente mostrano come il cammino del diritto dell’obbligazione dei nostri tempi sia da instradare nella legittimazione di strumenti che assecondino dinamiche sempre più complesse, nel segno di tutele effettive dell’interesse creditorio, detti strumenti non sembrano indurre a scartare come superato il modello di obbligazione cooperativa che sembrava oramai guadagnato nella nostra riflessione concettuale.
