Clausole abusive, assiologia consumeristica e strutture del diritto contrattuale (sui limiti delle scelte anti integrative della Corte di Giustizia)

The essay deals with recent trends in the area of the so called “post-unfairness” and, in particular, the effects of the invalidation of an unfair clause that appears to be essential for the validity of the contract. In particular, it critically examines the decisions of the Court of Justice of the European Union that are clearly contrary to solutions that supplement the contractual agreement.

Il saggio si occupa dei recenti orientamenti in tema di c.d. postvessatorietà ed in particolare degli effetti della caducazione di una clausola abusiva che si profili come essenziale ai fini della tenuta del contratto. In particolare si indagano, anche criticamente, le scelte della Corte di Giustizia dell’Unione europea spiccatamente contrarie a soluzioni integrative del regolamento negoziale.
