LA DISCIPLINA DELLE EMISSIONI IN ATMOSFERA NEL "TESTO UNICO AMBIENTE"

In the first place this paper deals with the discipline of atmospheric emissions contained in the "testo unico ambiente" (consolidation act about environment), pinpointing the fundamental principles of the law, such as the modes and procedural characteristics of the authorizing powers of the public authority and in particular the "emissions limits" framework imposed to operators. Secondly, it examines its consistency with the EU rules. In the end, it analyses the jurisdiction of State and Regions regarding rules and regulations of atmospheric emissions in the light of the amendment of Title V. Part II of the Constitution.
