Lex dicta, natura, vetustas: considerazioni a margine di D.39.3.2pr. Paul. 49 ad ed.

The article provides a new, detailed exegesis of the principium of D.39.3.2 from Paul’s XLIX libro ad edictum: the jurist, in the context of the commentary on the title of the praetorian edict dedicated to the actio aquae pluviae arcendae, enunciates a general rule for the management of water in a sloping territory such as that typical of Apennine Italy. In this field, the concepts of lex dicta and vetustas are of particular interest.

Il contributo fornisce una nuova, approfondita esegesi del principium di D.39.3.2pr. tratto dal XLIX libro ad edictum di Paolo in cui il giurista, nell’ambito del commento al titolo dell’editto pretorio dedicato all’actio aquae pluviae arcendae, enuncia una regola generale sulla gestione delle acque in un territorio in declivio, come quelli tipici dell’Italia appenninica. In quest’ambito oggetto di particolare attenzione sono i concetti di lex dicta e di vetustas.
