The essay investigates the scope of paragraph 1 of article 1227 of the civil code, concerning the contribution of the injured party’s negligence, also for the purpose of drawing arguments regarding the debated problem of the relevance of concurrent causation in torts. Considering the prevailing ratio inspired by a criterion of proportionality between the causal contribution by the damaging party and the extension of the indemnity obligation, rather than the principle of self-responsibility (as confirmed by the application of article 1227, paragraph 1, also to the damaged party who is incapable), an attempt is made to derive a criterion for selecting the concurrent causes (also natural) suitable for reducing the indemnity, identifying it in the unpredictability of the concurrent cause.
Il contributo indaga la portata del primo comma dell’art. 1227 c.c., in tema di concorso del fatto colposo del danneggiato, ricostruendone la ratio in chiave sistematica, anche allo scopo di trarre argomenti in ordine al discusso problema della rilevanza giuridica delle concause nel giudizio di responsabilità civile. Ritenuta prevalente la ratio ispirata ad un criterio di proporzionalità tra apporto causale da parte del danneggiante ed estensione dell’obbligo risarcitorio, invece che al principio di autoresponsabilità (come conferma l’applicazione dell’art. 1227, comma 1, anche al danneggiato incapace), si cerca di ricavare dalla norma un criterio di selezione delle concause (anche naturali) idonee a ridurre il risarcimento, individuandolo nell’imprevedibilità della causa concorrente.
