Nuove specifiche tecniche e correttivi “post Cartabia”: aggiornamenti e adeguamenti in tema di digitalizzazione del processo e di notificazioni telematiche

Il contributo si pone a valle dell’agitato percorso di aggiornamento e di adeguamento del complesso codicistico e normativo-regolamentare che disciplina l’impiego delle tecnologie dell’informazione e della comunicazione nel Processo Civile, principiato con il massivo intervento di riforma portato dal D.Lgs. n. 149/2022, proceduto con l’adeguamento delle Regole Tecniche portate dal D.M. 21 febbraio 2011, n. 44 e con la pubblicazione delle nuove Specifiche Tecniche di cui al Provvedimento del Direttore Generale D.G.S.I.A. 7 agosto 2024 e da ultimo culminato con i correttivi introdotti dal D.Lgs. 31 ottobre 2024, n. 164. L’obiettivo è quello di riassumere ed analizzare i profili e gli aspetti più tecnici di dette novelle, con principale considerazione per i meccanismi delle notificazioni e delle comunicazione telematiche, nonché per il capillare intervento di implementazione del domicilio informatico.

The paper il placed downstream of the unquiet process of updating and adjusting the codified and normative-regulatory complex that governs the use of information and communication technologies in the Civil Process, which began with the massive reform brought about by Legislative Decree no. 149/2022, proceeded with the adaptation of the Technical Rules brought by Ministerial Decree no. 44/2011 and with the publication of the new Technical Specifications set forth in the Order of the Director General of the D.G.S.I.A. of 7 August 2024, and finally culminated with the corrective measures introduced by Legislative Decree no. 164/2024. The objective is to summarise and analyse the profiles and the most technical aspects of said changes, with main consideration for the mechanisms of telematic notifications and communications, as well as for the widespread implementation of the electronic domicile.
