Povertà educativa, disagio sociale e criminalità minorile. Le misure introdotte dal c.d. decreto Caivano

Recently, Italy has witnessed an input of legislative measures aimed at reducing and combating juvenile delinquency and its causes. Some particularly serious acts committed by underage adolescents have been the subject of media attention and caused social alarm in the community. The so-called Caivano decree, implemented by the Italian government, aimed to provide support and educational opportunities to children from economically and culturally disadvantaged backgrounds but, in fact, shows a wider scope and heterogeneous content in the field of juvenile criminal justice. Following this legislative change, the system of laws and regulations thus established must be analysed and its suitability to meet the educational neeeds and the minors' best interests must be assessed.

Recenti interventi del legislatore si sono indirizzati verso la repressione della criminalità minorile e delle sue cause. Alcune gravi forme di manifestazione di tale criminalità hanno sollecitato l'attenzione dei mezzi di informazione, con un conseguente, diffuso allarme sociale. Con il c.d. decreto Caivano, presentato come un intervento urgente volto a offrire sostegno e opportunità educative ai minorenni in condizioni di deprivazione economica e culturale, sono state peraltro attuate modifiche di più ampia portata e di contenuto eterogeneo nell'ambito della giustizia penale minorile. Le modifiche attuate inducono a riflettere sui caratteri del sistema delineato dal legislatore e sulla sua idoneità a rispondere educativi dei minorenni e al loro migliore interesse.
