The essay analyses the evolution of the Italian legal framework on the form of resignation, considering also specific sectoral regulations - such as those concerning maternity and, more generally, parenthood protection - which provide for an administrative validation procedure. The last part of the paper examines the issue of resignation by facta concludentia, focusing on the recent case law on the presumption of resignation for unjustified absence, with some final remarks in a de iure condendo perspective.

Abstract
