The essay demonstrates that adopting a ‘Think Family’ perspective is grounded in the so-called neo-institutional conception of the family. In this model, derived from the Italian Constitution, the family structure is organized by the relationship of solidarity, which mediates the principle of agreement to prevent the degradation of family relationships to uncoordinated and tendentially conflictual relations. The essay analyzes the solidarity relationship as much in its ‘internal’ as in its ‘external’ side, thanks to which family rights receive support from private law. Particular attention is reserved to the duties to protect and paths to family mediation.
