The institution of “probation,” a form of judicial probation aimed for adults, was rewied by the recent justice reform law (Cartabia Reform, Dec. 30, 2022), where, even in the rewied version, was confirmed its high civic and reeducational value. Through probation, offenders can realize the paths to change own critical reinterpretation of their behavior. This is an interpretation of punishment that preserves its retributive value, but the challenge that institutions and associations take as welcoming these people into the activities and projects of a (re)educational nature, gives this particular penal measure a restorative purpose too. Probation concerns first and foremost the offender, it also verifies the skills, resilience, and responsibility of those it accommodates. With these premises, in 2023 a collaboration between some professors of the Catholic University of the Sacred Heart and the Piacenza Volunteer Service Center led to the realization a training course and later a Research involving the Associations that take in the people on probation.
L’istituto di “messa alla prova”, una forma di probation giudiziale rivolta agli adulti, è stato rivisto dalla recente legge di riforma della giustizia (Riforma Cartabia, 30 dicembre 2022), che, pur nella revisione, ne ha confermato l’alto valore civico e rieducativo. Attraverso la messa alla prova gli autori di reato hanno la possibilità di realizzare percorsi finalizzati al cambiamento e alla rilettura critica dei propri comportamenti. Si tratta di una interpretazione della pena che ne conserva la valenza retributiva, ma la sfida che enti e associazioni assumono nell’accogliere queste persone in attività e progetti di carattere (ri)educativo conferisce a tale particolare misura penale anche una finalità riparativa. La prova riguarda innanzitutto l’autore di reato ma verifica anche le competenze, la tenuta, la responsabilità di chi accoglie. In linea con queste premesse nel 2023 una collaborazione tra alcune docenti dell’Università Cattolica del Sacro Cuore e il Centro Servizi per il Volontariato di Piacenza ha portato alla realizzazione di un percorso formativo e in seguito ad una Ricerca che ha coinvolto le Associazioni che accolgono le persone messe alla prova.
