The affirmation of care as a characteristic of inter-subjective relations is linked to the overcoming of a conception of just action based on the scheme of correspondence/reciprocity: that is, on acting for the evil/harm of those who are deemed to act in contrast to the interests or opinions of the judging one and for the good/benefit, only, of those who produce advantages for this latter. The risks of such a commutative vision of justice are highlighted, insofar as multiplying evil and producing conflicts and wars. As an antithesis, an idea of justice is proposed understood as loyalty to the good (as aimed at making just, for all the subjects involved, relationships that have not been so) even in the face of evil: of this, recalling both the correspondence to the principles of the Italian Constitution and the biblical grounds. It is emphasised that criminal law, on the one hand, has historically made the aforementioned commutative vision of justice its own, disseminating it on a cultural level, while, on the other hand, it shows today some elements that move away from it.
L’affermazione della cura quale caratteristica dei rapporti intersoggettivi si ricollega al superamento di una concezione dell’agire giusto fondata sullo schema della corrispettività: cioè sull’agire per il male di chi sia ritenuto operare in contrasto rispetto agli interessi o alle opinioni del giudicante e per il bene, soltanto, di chi produca a quest’ultimo dei vantaggi. Di una simile visione commutativa della giustizia vengono evidenziati i rischi, in quanto moltiplicativa del male e produttiva dei conflitti e delle guerre. Viene proposta, in antitesi, un’idea della giustizia intesa come fedeltà al bene (come rivolta a rendere giusti, per tutti i soggetti coinvolti, rapporti che non lo siano stati) anche dinnanzi al male: di ciò richiamando sia la corrispondenza ai principi della Costituzione italiana, sia i fondamenti biblici. Si evidenzia che il diritto penale, da un lato, ha fatto propria, storicamente, la suddetta visione commutativa della giustizia, diffondendola sul piano culturale, mentre, dall’altro lato, manifesta oggi alcuni elementi che se ne allontanano.
