Dogmatica e metodo. Angelo Falzea e Luigi Mengoni

The importance of dogmatic in the juridical method, particularly in private law, is the subject of this writing. The path follows the traces of the authors who across the last century and the current one more intensely marked in Italy their work by the dogmatic: Falzea and Mengoni. Both are conscious of the necessity of dogmatic as a tool for conceptualizing categories and principles, and at the same time of the renovation of it. Falzea specifically deals with the dogmatic of principles as coordinated with the dogmatic of rules. Mengoni develops a theory of method in which dogmatic works as a consistency control of interpretation with the juridical system. The two authors agree that new dogmatic is permeated by the values enshrined in the Constitution and whose cognitive role directs the juridical discourse.
