Profili lavoristici della legislazione antiebraica fascista

The labour law profiles of the implementation of fascist anti-Semitic legislation have had relevant effects for thousands of Italian jews, even if the issue has not always been deeply analysed. The purpose of the essay is to outline the main institutions arising from the racist legislation of 1938. At the same time, it appears necessary to highlight how the “reparatory” measures implemented after the end of the fascist regime remained often ineffective, even because of a too cautious approach of a large part of Italian courts.

Sebbene in apparenza secondari rispetto ad altri aspetti, i profili lavoristici che scaturirono dall’applicazione della legislazione antisemita fascista ebbero conseguenze rilevanti per migliaia di ebrei italiani. Il saggio ha quale scopo quello di tratteggiare i principali istituti, spesso negletti, derivanti dalla legislazione razzista del 1938. Al contempo appare necessario evidenziare come le misure “riparative”, poste in essere successivamente alla caduta del regime fascista, rimasero in molti casi ineffettive, anche a causa di un approccio eccessivamente timido di ampia parte della magistratura del tempo.
