The paper is aimed at analyzing the problematic features concerning the allocation of the burden of proof in the trial instituted by the cultivator omitted from the case of transfer. The survey will review the case law in the field of agrarian preemption, while taking the opportunity to conduct systematic considerations on the rule of the article 2697 of the Italian civil code and its corollaries, as interpreted from the most authoritative doctrine.
