The case note concerning the decision of the Court of Rome of 13 January 2021 explores the relevant and ever-present issues of the discovery, identification, recovery and return of works of art subtracted during war campaigns and armed conflicts. After a reconstruction of the historical events under consideration in the decision and a recognition of the applicable legal sources pertaining to Nazi looted art, the case note investigates theItalian discipline of the adverse possession of works of art subject to (violent) spoliationand offers some conclusive considerations about the best practices to be followed by art market operators to participate in establishing a more conscious and responsible art market.
