Luigi Mengoni, who died 10 years ago, was one of the leading scholars in the Italian private law of 20th century. In the second half of his scientific experience he came to methodology, especially exploring the relationship between pure interpretation (hermeneutics) of individual rules and the totality of legal system. Educated in the idea of juridical positivism, he abandoned it, proposing a new path of science, in which the juridical system incorporates in itself social and moral values, that the author calls «critical dogmatics».
