Innovazione tecnologica e partecipazione dei lavoratori: un confronto fra Italia e Germania

The article, taking the cue from the recent reform of the German Law on the constitution of the firm (Betriebsverfassungsgesetz), deals with the legislative framework of the employee participation in the process of technological innovation in Italy and Germany, while also examining some practical implementations in the two Countries. The author deems it necessary for the Italian legal order to move towards strategical employee participation in the management of enterprises, by means of the implementation of Art. 46 of the Constitution.

Il saggio, prendendo spunto dalla recente riforma della legge tedesca sull’ordinamento aziendale (Betriebsverfassungsgesetz), esamina il quadro legislativo di sostegno alla partecipazione dei lavoratori nei processi di innovazione tecnologica in Italia e Germania, confrontando, altresì, alcune realizzazioni pratiche nei due Paesi. L’autore ritiene necessario che l’ordinamento italiano si muova verso l’estensione della partecipazione alle decisioni strategiche delle imprese, mediante l’attuazione dell’art. 46 della Costituzione.
