With this contribution, the author examines the case of the fiduciary contract, recently expressly mentioned in the law of 22 June 2016 n. 112 (so-called law on the "Dopo di noi"), measuring its compatibility with some more or less traditional principles of the legal system, such as the principle of typicality of rights in rem and the generic liability of the debtor.
