The paper focuses on the so-called obstetric violence, i.e., the medical malpractice consisting of disrespect and/ or abuses to the detriment of women during their labor or when they give birth, as well as during healthcare services concerning the sexual and reproductive sphere. The main goal is to start a debate in Italy on a topic already considered by foreign lawmakers, also for punishment purposes. After an empirical-criminological survey of the cases and the misconduct to be labeled as ‘obstetric violence’, the paper analyzes the legal tools available in Italy. From a law reform perspective, the Author reflects on the (non-criminal) strategies to prevent distortions of the doctor-patient relationship as well as on the harm to women’s self-determination and dignity, particularly in respect of the rules on informed consent
Il contributo esamina il fenomeno della c.d. violenza ostetrica, ossia degli atteggiamenti irrispettosi e/o abusanti tenuti dagli esercenti le professioni sanitarie nei confronti delle donne durante il travaglio, il parto e l’erogazione delle prestazioni sanitarie legate alla sfera sessuale e riproduttiva. Il saggio si propone di avviare la riflessione su un tema che, all’estero, ha già impegnato l’intervento del legislatore, anche sul fronte punitivo. A valle dell’inquadramento empirico-criminologico della casistica e della descrizione delle condotte effettivamente riconducibili alla nozione di “violenza ostetrica”, segue una verifica degli strumenti di tutela offerti dall’ordinamento italiano. In prospettiva de lege ferenda, l’Autrice riflette sulle strategie (non penali) di prevenzione delle distorsioni del rapporto medico/partoriente e delle offese all’autodeterminazione e alla dignità delle donne, con particolare attenzione alla disciplina del consenso informato.
