Il distacco transnazionale dei lavoratori nell’UE: dal dumping sociale alle nuove prospettive del diritto del lavoro europeo

The essay deals with the evolution of the legislative framework and case law related to the transnational posting of workers in the European Union, by placing it in the frame of the complex phenomena of the internal market building and Union enlargement. In particular, according to the author the most recent developments reveal a renewed social attention by the EU, which fights more convincedly the social dumping and fosters a stronger upward convergence of employment conditions. The author concludes its work by examining the Italian law in this field, now concentrated in the legislative decree n. 136/2016 and recently amended: though greatly improved, this legislation still conserves problematic aspects linked to the lack of “erga omnes” effects of collective agreements.

Il saggio ripercorre l’evoluzione normativa e giurisprudenziale che ha caratterizzato il distacco transnazionale dei lavoratori nell’Unione europea, collocandola all’interno delle complesse dinamiche di costruzione del mercato interno ed allargamento dell’Unione. In particolare, secondo l’autore le più recenti novità legislative e giurisprudenziali manifestano una rinnovata sensibilità sociale dell’Unione, che contrasta con più decisione il dumping sociale e spinge verso una maggiore convergenza delle condizioni di impiego nel progresso. L’autore conclude con una l’esame della disciplina italiana, ora compendiata nel d.lgs. n. 136/2016 e recentemente novellata, nella quale ravvisa persistenti aspetti problematici connessi all’ambito di efficacia dei contratti collettivi.
