Ruling no. 5/2021 of the Italian Constitutional Court provides an opportunity to reflect on the width of the autonomy accorded to Italian Regions in establishing sanctioning systems for the enforcement of their own laws; that, with regard not only to the relationship with criminal law – which falls within the State’s exclusive powers – but also to other issues raised by a regional law, which provides offenders with a wide power to comply after the commission of the offence has been ascertained.
