Pubblica fede e opponibilità dell’acquisto per usucapione di servitù nel sistema tavolare

The essay analyses a recent ruling of the Court of Cassation concerning the land registry system (sistema tavolare) that is in force in the Italian regions parts of the Austrian empire until the end of the First World War and that stems from the Austrian law. The Court determines the proper interpretation of the rules on adverse possession against the third person who purchases a right relying on the accuracy of the land register. Moreover, the ruling confirms that the protection of the third person requires good faith.

La sentenza della Corte di Cassazione n. 19054/2021 ristabilisce la corretta interpretazione delle regole che nel sistema tavolare disciplinano l’opponibilità di un diritto acquistato in via extratavolare per usucapione al terzo acquirente sulla fede del libro fondiario. Secondo la Corte di Cassazione, la previsione in merito (art. 5, co. 3 r.d. n. 499/29) trova applicazione anche quando si contrappongono diritti tra loro non incompatibili, ovvero quando il diritto conseguito in via extratavolare potrebbe concorrere con il diritto intavolato dal terzo, come la servitù rispetto alla proprietà. Trova inoltre ulteriore conferma l’orientamento secondo cui il sintagma «sulla fede del libro fondiario» deve essere riferito alla buona fede del terzo.
