The article analyses the issue of labour exploitation and the criminal regulation aimed at its contrast. At a criminological level, work contexts highlight different forms of exploitation, the most recent of which are linked to the impact of the new technologies. This change has been further induced, among other reasons, by the Covid-19 outbreak and consequent pandemic. The sanitary emergency has led to an increased use of smart working, which in turn has proved to be a very demanding model of work. The need to ensure social distancing and like-precautionary measures on the workplace has created multiples occasions for the exploitation of workers. To better assess the effectiveness and the efficacy of criminal law in countering these forms of labour exploitation, the provisions of art. 603 bis of the Italian Criminal Code, concerning a series of illicit conducts in this domain, are analysed. These provisions are becoming increasingly important in the criminal justice system, giving rise to criminal proceedings and judgments. Article 603 bis of the Italian Criminal Code currently represents a point of reference in the fight against labour exploitation. The complexity of this multifaceted phenomenon, however, requires to combine criminal law with other tools, and especially with preventive measures that promote decent work conditions, transparency of labour intermediation and adequate tools for the timely identification of the various forms of exploitation.

L’articolo esamina il tema dello sfruttamento della persona a scopo lavorativo e degli strumenti giuridici finalizzati al suo contrasto. Sul piano criminologico, vari contesti lavorativi presentano forme diffuse di sfruttamento, le più recenti delle quali sono collegate all’impatto delle nuove tecnologie. Tale mutamento è stato indotto anche dall’emergenza legata alla pandemia da Covid-19. Il carattere sanitario di questa emergenza ha sollecitato un significativo incremento dello smart working, che si è tuttavia rivelato un modello idoneo a creare condizioni lavorative particolarmente gravose. La necessità di assicurare il distanziamento sociale e analoghe misure precauzionali ha offerto nuove possibilità di espansione del mercato del lavoro ma anche ulteriori occasioni di sfruttamento della persona. Al fine di esaminare l’effettività degli strumenti penalistici nel contrasto di queste forme di sfruttamento, è oggetto di specifica analisi l’art. 603 bis c.p. Questa disposizione rappresenta attualmente un punto di riferimento nelle strategie di repressione delle pratiche di sfruttamento in ambito lavorativo. La complessità di questo fenomeno, tuttavia, richiede che il diritto penale sia affiancato da altri strumenti giuridici, in particolare da misure preventive in grado di promuovere condizioni lavorative dignitose, la trasparenza dell’intermediazione in ambito lavorativo e l’identificazione tempestiva delle differenti forme di lavoro irregolare.
