The Author deals with the subject of anticipated pensions by placing it in the context of demographic crisis, active aging policies and measures aimed at preserving the balance of the pension system. Institutes of anticipated retirement, which are changeable and often temporary limited, lie at the crossroads between the solidarity principle of art. 2, Constitution, and the principle of pensions adequacy of art. 38, Constitution, between social insurance and social assistance. The setting of the pension age at a level (67 years) which is quite high and even growing in line with life expectancy imposes measures of anticipated retirement drawing on the general solidarity: this is necessary to take duly into account different social needs, also constitutionally protected. However, it is fundamental that in this fine and complex work the legislator always sticks to the equality principle.
L’Autrice esamina il tema del pensionamento anticipato collocandolo nel contesto della crisi demografica, delle politiche di invecchiamento attivo e delle misure volte a salvaguardare l’equilibrio del sistema pensionistico. Gli istituti di pensionamento anticipato, cangianti e sovente temporalmente delimitati, si innestano al crocevia tra il principio solidaristico dell’art. 2, Cost. e il principio di adeguatezza del trattamento pensionistico dell’art. 38, Cost., tra previdenza e assistenza. La fissazione dell’età per il pensionamento di vecchiaia a un livello elevato (67 anni) e tendenzialmente crescente al progredire dell’aspettativa di vita impone la previsione di meccanismi di pensionamento anticipato che richiedono il ricorso alla solidarietà generale, onde tener conto di istanze sociali anche di rango costituzionale. E’, tuttavia, fondamentale che nell’opera delicata e complessa della loro predisposizione il legislatore ispiri sempre la propria azione al principio di uguaglianza.
