Two recent decisions of the Italian Constitutional Court (n. 180/2018 and n. 14/2019) call for a reflection upon the topic of lawyers’ strike in criminal proceedings. This essay seeks to highlight the discrepancies between the provisions of the “Code of Self-regulation of Lawyers’ Strike” and the main trends in case-law.
Le recenti pronunce della Corte costituzionale sull’astensione dei difensori nei procedimenti penali con imputati in custodia cautelare (n. 180/2018 e n. 14/2019) sollecitano una riflessione, in termini più ampi, sull’astensione dei difensori dalle udienze penali. Il presente contributo intende esaminare la corrispondenza – o meno – tra gli orientamenti giurisprudenziali in materia e le previsioni del “Codice di autoregolamentazione delle astensioni dalle udienze degli avvocati”.
