The essay focuses on the legal system of administration's responsibility in Italy during Covid-19. To mitigate the fear of pubblic servants and solicit their activism in support of the economy, the Legislator with the d.l. n. 76/2020 introduced experimental rules on liability. In particular, with the art. 21 of the decree, the liability for negligence, even gross, for the acts acting until the december 2021 was excluded. The paper examines this new discipline looking at the peculiarities of the health system and responsibilities of technical and consultative body.
