On 23 October 2019 the European Parliament and the Council adopted Directive (EU) 2019/1937, a piece of secondary legislation encompassing the first organic regime concerning whistleblowing to have been elaborated at supranational level, that Member States will be required to transpose by 17 December 2021. This paper aims to clarify the directive’s impact on the Italian legal framework, which is currently defined by Law 179/2017, as well as the opportunities to be taken on the occasion of the directive’s implementation. By means of a comparison between these two regimes, both their different ways of conceiving whistleblowing and the respective implications for the domestic legislator are highlighted. This will require the same legislator to adopt a radical change of perspective. As far as the national level is concerned, the analysis will focus on provisions affecting the Public Administration.
Il 23 ottobre 2019 Parlamento europeo e Consiglio hanno adottato la direttiva (UE) 2019/1937, prima disciplina organica in materia di whistleblowing elaborata a livello sovranazionale, che gli Stati membri sono chiamati a recepire entro il 17 dicembre 2021. Il presente contributo si propone di mettere in luce l’impatto della direttiva sul quadro normativo nazionale, attualmente definito dalla legge n. 179/2017, e le opportunità da cogliere in sede di attuazione. Attraverso un confronto tra le due discipline viene evidenziata la diversa concezione dell’istituto e le implicazioni che ne discendono per il legislatore nazionale, chiamato ad operare un profondo cambiamento di prospettiva. Per quanto riguarda il versante interno, l’analisi si concentra sulle disposizioni che riguardano la pubblica amministrazione.
