The decisions contained in the Liber Sententiarum of the mayor of Milan, relating to the year 1385 and now published, give us, albeit in a partial and incomplete form, a vivid image of the administration of criminal justice in Milan during the Gian Galeazzo Visconti’s government. The sentences, as regards the crimes of theft and robbery considered here, show an infrequent incidence of such criminal figures and, at the same time (in particular as regards the furtum), the propensity for a decisive repressive response by the municipal courts. The analysis of the sentences also allowed us to formulate some reconstructive hypotheses around the rules in force at the time, which seem to be substantially respected by the judges. In the context of an advanced phenomenon of ‘publicization’ of punitive justice (which is perceived above all in the procedural sphere), there are, however, some traces of the survival of a ‘negotiated’ dimension of criminal law, which is expressed above all in the forms of private transactions around the penalty.
