Assistenza al familiare disabile e obbligo datoriale di adottare “ragionevoli accomodamenti”

The paper focuses on some interesting issues related to the assistance by the employee to his disabled relative. After examining the Italian case law concerning art. 33, paragraph 5, L. n. 104 of 1992 - which allows the worker to choose, where possible, the workplace closest to the home of the person to be assisted - the author focuses on the concept of "reasonable accommodation" expressed by art. 2 of the United Nations Convention on the Rights of Persons with Disabilities of 13 December 2006. In this perspective, particular attention is paid to the regulation of the entrepreneur's power adopted by the most innovative forms of protection of people with disabilities.

Il contributo si concentra su alcune interessanti questioni relative all’assistenza da parte del lavoratore subordinato al proprio familiare disabile. Dopo aver esaminato gli orientamenti giurisprudenziali sviluppatisi attorno all’art. 33, comma 5, l. n. 104 del 1992 – che consente al lavoratore di scegliere, ove possibile, la sede di lavoro più vicina al domicilio della persona da assistere – l’autore si sofferma sul concetto di "ragionevoli accomodamenti" espresso dall’art. 2 della Convenzione delle Nazioni Unite sui diritti dei disabili del 13 dicembre 2006. In questa prospettiva, particolare attenzione è dedicata ai limiti posti alla discrezionalità dell’imprenditore dalle più innovative forme di tutela dei soggetti con disabilità.
