The Author analyses the grounds of the Italian Supreme Court decision dates from 15 April 2019 n. 10540, that finally confirms the recognition of the New Jersey judgement dating back to 2008 awarding enormous damages to Citibank against Parmalat. The S.C. excludes that the Italian vis actractiva concursus principle on the assessment of creditors’ claims is a principle of public procedural order, as a reason for refusing recognition. The decision is in line with the CJEU interpretation about the conflicts among UE State Members on Insolvency and Civil and Commercial jurisdiction
