According to the Joint Chambers the judge whom, in the executive phase, applies the discipline of continuing offence (“reatocontinuato”) pursuant to article 671 ICCP, has to respect the punishment limits provided for by article 81 § 2 ICC. The decision respectably highlights how the judge’s power in determining the quantum of punishment for continuing offence has to take place in respect of the same rules both in the trial and the executive phase, also in consideration of a legal framework which establishes a process concerning a plurality of agents as a residual and casual hypothesis.
Secondo le Sezioni unite il giudice che applichi nella fase esecutiva la disciplina del reato continuato ai sensi dell’art. 671 c.p.p. deve osservare i limiti di pena fissati dall’art. 81, comma 2, c.p. La sentenza, in modo condivisibile, sottolinea come il potere del giudice di determinare la pena per il reato continuato deve avvenire nel rispetto delle stesse regole sia nella fase di cognizione che nella fase esecutiva, anche in considerazione di una disciplina codicistica che configura il processo cumulativo quale ipotesi residuale e del tutto casuale.
