The work takes into account Giorgio Luraschi’s essays, and especially those on the Latini coloniarii and the Latini luniani, in order to describe these last ones’ system of laws and analyse Gai. 3.56 as the only existing account on the lex lunia. Concerning this the fictio implying false the Latin colonies deductio is considered to be the only way for informally manumitted slaves to acquire Latinity. Besides the expression “ac si lex lata non esset” is not considered to be a further fictio but rather a mere explanation given by the jurist about the effects of the rule.

Abstract
The work takes into account Giorgio Luraschi’s essays, and especially those on the Latini coloniarii and the Latini luniani, in order to describe these last ones’ system of laws and analyse Gai. 3.56 as the only existing account on the lex lunia. Concerning this the fictio implying false the Latin colonies deductio is considered to be the only way for informally manumitted slaves to acquire Latinity. Besides the expression “ac si lex lata non esset” is not considered to be a further fictio but rather a mere explanation given by the jurist about the effects of the rule.File | Dimensione | Formato | |
