Starting from a possible figure of gesture, as an action or a practice which brings a meaningful form that could be recognised and repeated (and so reformed), the paper suggests interpreting the difference between experiencing a rule and positivising it as a gestural difference. In order to perform a theoretical gesture, graphic tools and the practice of writing are indispensable. The three main chapters investigate the transition from experience as a synthetic gesture, to positivisation as an analytical gesture, in three different fields of study: anthropology, mathematics and law. The problem is how theoretical knowledge deals with its own positive form when the living sense is to be known. From the performance of a rite to the ethnographic description, from the experience of an error to the axiomatic demonstration and from the tradition of customs to the autonomy of written law, positivisation informs the experience in a normative way. The conclusion criticizes the theoretical and graphic perspective that the philosophy of law assumes. The positivization of customary law is a typical example of a gestural transition. How should the normativity of a scientific positive question be dealt with when the very living normativity is to be known? Perhaps this paradox of normative recursion requires a new ethos of knowledge.
