CONTINUITÀ D’USO DELLE INFRASTRUTTURE IDRAULICHE NELLE REALTÀ RURALI ROMANE: REGOLAMENTAZIONE ED EFFETTI GIURIDICI

In the Roman rural territories, the constant use of various infrastructures, especially the hydraulic ones whose archaeological remains still exist nowadays, is not only due to social or economic factors, but it also responds to an actual legal norm that requires respect for the preexisting situation that has been well used for a long time. At both public and private level this can be observed in the principle – very often repeated by the sources – that the water artifacts present from time immemorial in the territory must be maintained because of their proved usefulness through both long use and continuous maintenance.
