In the face of genocide, torture, incest or sexual and spiritual abuse committed in religious contexts — what this book terms 'foundational crimes' that result in an 'impediment to being' — achieving justice seems impossible. Indeed, a certain kind of justice is impossible: justice that seeks to measure the immeasurable; to judge the guilty (who are often victims themselves) for irreparable and irreversible acts; and to punish crimes for which there can't be an adequate sanction. Antoine Garapon, a jurist, philosopher and former magistrate with an extraordinary personality, points to a possible path of justice in the face of the impossible, without compromising on the enormous complexity of the demand for justice or the extreme difficulty of the response. Over hundreds of meetings with survivors of these crimes, most recently victims of sexual assault and other abuses committed by clergy, the author has seen the “restorative path” to justice emerge. Through listening, which has resonated with Antoine Garapon's vast experience and cultural refinement, it has become clear that something is possible — indeed, necessary — if we move beyond simplification and regulatory dictates (although these are indispensable) towards a place where every human being, if respected and supported, can regain their ability to act, return to 'being', return to the world and rediscover the lost innocence caused by the evil they have suffered or inflicted. Completing this journey – the restorative path – enables justice to be served without detracting from the significance, weight and gravity of what has happened and remains. The fact that this justice is possible, and ultimately consists in a return to life, is the good news contained in this book, which concerns us all. Despite the sombre themes addressed, Antoine Garapon leads the reader upwards without irenicism because the “faces” that guide the journey and permeate the “lived” pages of this book teach us justice even more than books do. This beautiful book inspires confidence and offers new and meaningful insights into restorative justice and justice in general.

Davanti al genocidio, alla tortura, all’incesto o agli abusi sessuali e spirituali commessi nei contesti religiosi – quelli che in questo libro sono chiamati i «crimini fondativi» che causano un «impedimento a essere» – la giustizia sembra impossibile. Una certa giustizia, infatti, lo è: è impossibile la giustizia che pretende di commisurare l’incommensurabile, di giudicare i colpevoli (spesso vittime a loro volta) di fatti irreparabili e certo irreversibili, di punire crimini per cui non esiste pena adeguata. Antoine Garapon, giurista e filosofo, già magistrato, intellettuale dalla straordinaria personalità, indica qui un percorso di giustizia possibile davanti all’impossibile, senza fare sconti all’enorme complessità della domanda di giustizia e all’estrema difficoltà della risposta. È la «via riparativa» alla giustizia che l’Autore ha visto delinearsi nell’arco di centinaia di incontri con i sopravvissuti a quei crimini, da ultimo soprattutto con le vittime di aggressioni sessuali e altri abusi commessi da religiosi: l’ascolto, che ha risuonato nella vastità di esperienza e nella raffinatezza culturale di Antoine Garapon, ha rivelato che qualcosa è possibile – anzi: è necessario –, a condizione di andare oltre ogni semplificazione, oltre il mero dettato normativo (pur indispensabile), verso quel luogo misterioso dove ogni essere umano, se rispettato e accompagnato, può recuperare capacità di azione, tornare a ‘essere’, ritornare al mondo, ritrovare l’innocenza perduta a causa del male subito o inferto. Il compiersi di questo cammino – la via riparativa – consente il compimento della giustizia, senza scalfire la portata, il peso, la gravità di ciò che è, e resta, accaduto. Che la giustizia sia possibile e consista, in fin dei conti, nel ritorno alla vita è la buona notizia contenuta in questo libro che riguarda tutti. A dispetto dei temi cupi affrontati, Antoine Garapon conduce il lettore lungo una via che porta in alto, senza irenismi, perché a guidare il cammino, e a intridere le pagine ‘vissute’ di questo libro, sono i «volti» che, ancor più dei libri, ci insegnano la giustizia. Questo è un libro bello, che ispira fiducia e dice qualcosa di nuovo e significativo sia per la giustizia riparativa, sia e soprattutto per la giustizia tout court.
