Most social work situations involving minors and their families present numerous and complex legal and social issues—even those that appear relatively straightforward at first glance. The interdependence between social work and the legal field highlights the need for effective communication and collaboration between the two professions (Weil, 1982; Orji, 2016). Social workers, like lawyers, work with people—often at the same time (Taylor, 2006)—many of whom are in situations of hardship, significant stress, or vulnerability. The international literature on this topic indicates that difficulties in the relationship between social and legal professionals stem from various factors, including prejudice, lack of communication, and a deficit of mutual respect and trust (Reese, Sontag, 2001). A particularly challenging aspect that emerges is the presence of hostility between professionals, which negatively affects collaboration, ultimately to the detriment of the child and their family. In order to work together effectively, it is essential to manage mutual biases and, above all, to reconceptualize the roles not as opposing sides, but as parts of the same network working toward a shared goal. Given the importance of the relationship between social workers and lawyers in the increasingly demanding context of services for children and families—and considering the limited Italian literature on this subject—this study aims to explore the issue in the Lombardy region using a mixed-methods approach. The first phase is quantitative, based on two questionnaires (one for social workers and one for lawyers) designed to investigate the complexity of the phenomenon. The second phase is qualitative and involves focus groups, with the aim of gaining a deeper understanding of the nature of the relationship between the two professional roles (Bryman, 2012). The questionnaire for social workers received 630 responses, while the one for lawyers received 128 responses, out of similarly sized populations. Following this, three focus groups were conducted with both social workers and lawyers to delve further into the themes that emerged from the survey data. The results show that social workers are the professionals who most frequently interact with lawyers (once a month or more). However, 47% of lawyers report difficulties in contacting social workers and feel excluded from the support planning process for families. Social workers, in turn, report that lawyers are particularly helpful when acting as mediators—supporting communication with families and facilitating relationships—but they also express concern that lawyers may influence family decision-making. Additionally, social workers feel that their role is not sufficiently recognized by lawyers and stress the importance of better mutual understanding of each other's roles and competencies. Both professional groups agree that improving communication, developing shared working protocols, and fostering greater collaboration—centered on the well-being of the child—would be beneficial in strengthening their professional relationship.
La maggior parte delle situazioni di social work in cui sono interessati i minori e le loro famiglie presentano numerose e complicate questioni legali e sociali, anche quelle situazioni che sembrano apparentemente più semplici. L’interdipendenza del lavoro sociale e giuridico focalizza l'attenzione sulla necessità di un'efficace comunicazione e collaborazione tra le due professioni (Weil, 1982; Orji 2016). Gli assistenti sociali, come gli avvocati, lavorano con le persone, anche nello stesso momento (Taylor, 2006), molte delle quali si trovano in una situazione di difficoltà, grave fatica e stress. La letteratura internazionale sul tema afferma che le difficoltà nel rapporto tra le professioni sociali e giuridiche sono dovute a una serie di fattori come il pregiudizio, la mancanza di comunicazione, rispetto e fiducia tra i professionisti (Reese, Sontag, 2001). In particolare, un elemento di difficoltà che emerge è dato dal sentimento di ostilità tra i professionisti che inficia negativamente la collaborazione in ottica di sostegno al minore e alla sua famiglia. Al fine di poter lavorare congiuntamente sarebbe fondamentale riuscire a tenere controllati i reciproci pregiudizi, ma soprattutto riuscire a ripensarsi come soggetti non su schieramenti opposti ma parti di una rete che opera verso la stessa finalità. Data l’importanza della relazione tra assistenti sociali e avvocati in un contesto di crescente richiesta come quello dei servizi per minori e famiglie e la limitata letteratura italiana disponibile su questo argomento, la presente ricerca si propone di approfondire ed esplorare il tema nel territorio Lombardo tramite una metodologia mixed methods. La prima parte è quantitativa, volto ad approfondire la complessità del fenomeno attraverso due questionari, uno per assistenti sociali e uno per avvocati; una seconda parte qualitativa tramite dei focus group, per comprendere nello specifico la natura della relazione tra le due figure professionali (Bryman, 2012). Il questionario per assistenti sociali ha raggiunto 630 risposte, quello per avvocati, 128 risposte, su un numero totale di popolazione simile. Successivamente sono stati svolti tre focus group, per approfondire quanto emerso nei questionari, alla presenza sia di assistenti sociali che avvocati. I dati dicono che sono gli assistenti sociali la figura professionale che si interfaccia con gli avvocati con un’alta frequenza di contatti (una volta al mese o più). Il 47% degli avvocati riferisce di contattare con difficoltà gli assistenti sociali e di non sentirsi coinvolti dai professionisti sociali in merito al progetto di aiuto per la famiglia. Gli assistenti sociali riportano, invece, che la presenza dell’avvocato sia molto importante per l’assistente sociale quando riveste il ruolo di mediatore, cioè se assume un ruolo di supporto alla relazione con la famiglia e di mediatore nella comunicazione, ma ritengono anche che possa influenzare le famiglie nelle scelte. Reputano inoltre di essere poco riconosciuti dagli avvocati e riconoscono come sarebbe importante avere una maggiore conoscenza dei rispettivi ruoli e competenze Entrambe le figure professionali, ritengono possa essere utile per migliorare il rapporto professionale una maggiore comunicazione, la stesura di protocolli comuni utili al lavoro e una maggiore collaborazione avendo come focus il benessere del minore.
