This report is built on the hypothesis that the simultaneous influence of several notions of justice has a significant bearing not only on policy outcomes, such as the measures designed and implemented by the EU to address the issue of migration, but also the very relationships between the Union’s levels of governance. If the national and supranational connections are a delicate issue in virtually every area of policy, it appears to be even more critical with regards to the normatively laden issue raised by the migration crisis. MS’ traditions of citizenship and other deep-seated practices of inclusion in and exclusion from national political communities profoundly affect the Union’s authority in this composite policy area (combining the Internal Market and the Justice and Home Affairs).
